SUBJECT: | Adopt Ordinance Vacating Portions of Texas Street, Burnett Street and Cherry Street within Downtown for the Burnett Lofts Development and Authorize Conveyance of an Easement to Oncor Electric Delivery Company, LLC for Electrical Equipment and Appurtenances on Approximately 0.041 Acres of City-Owned Property Located on Portions of Texas Street, Burnett Street and Cherry Street (COUNCIL DISTRICT 9) |
RECOMMENDATION: |
It is recommended that the City Council: 1. Adopt the attached ordinance vacating portions of Texas Street, Burnett Street and Cherry Street within Downtown for the Burnett Lofts development to permit Oncor to locate their pad mounted transformers and other equipment on private property rather than in the public right-of-way; 2. Waive any and all purchase fee value of the vacated land in accordance with City policy; 3. Authorize conveyance of an easement to Oncor Electric Delivery Company, LLC, for electrical equipment and appurtenances on approximately 0.041 acres of City-owned property located on Texas Street, Burnett Street and Cherry Street; and 4. Authorize the City Manager or his designee to execute and record all necessary documents to complete the conveyance. |
DISCUSSION: |
Gorrondona Associates, on behalf of adjacent property owners, Burnett Lofts FW, LLC and the City of Fort Worth (City), has requested vacation of these portions of Texas Street, Burnett Street and Cherry Street to be replatted as private property to permit Oncor to place their pad mounted transformers and other electrical equipment on private property rather than in the public right-of-way to provide service to the proposed development of Burnett Lofts, a mixed-use residential development, including apartments, amenity spaces, restaurant and retail spaces. The City Plan Commission recommended approval of this request at its meeting on October 24, 2018. An acceptable final plat (FS-15-089) has been received in accordance with the Subdivision Ordinance. The City originally obtained the above mentioned right-of-way through plat dedication. The City did not expend any funds to purchase the right-of-way easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, Mayor and Council Communication (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-way easement for the streets. The City will convey to Oncor Electric Delivery Company, LLC, an easement for electrical equipment and appurtenances across City-owned property on the portions of Texas Street, Burnett Street and Cherry Street. The easement is needed for pad mounted transformers and pull boxes to support the development of the mixed-use project. This project is located in COUNCIL DISTRICT 9. This M&C does not request approval of a contract with a business entity. |

The Director of Finance certifies that approval of these recommendations will have no material effect on City funds. Any assets recorded on the City's financial statements associated with this land will be adjusted upon approval. |
