Eligibility and Requirements

• You have a valid Texas driver’s license or permit, proof of active military duty status, or are the spouse or dependent child of a person on active military duty

• By requesting a Driving Safety Course, you are entering a plea of no contest to this charge

You ARE NOT eligible if:

• • You have taken a driving safety course within the last 12 months

  • You held a commercial driver's license at the time of the offense or if you hold a commercial driver's license at the time of the request for defensive driving

  • The offense was committed in a construction or maintenance zone where workers were present

  • You were speeding 25 MPH or more over the limit

  • You were speeding more than 95 MPH

  • You were charged with passing a school bus loading or unloading children

  • You were charged with leaving the scene of a collision after causing damage to a vehicle

  • You were charged with leaving the scene of a collision and failing to give information or render aid




• If you meet the above requirements you may request to take a Driving Safety Course. You will receive written instructions for your Driving Safety Course request indicating applicable fees.

  • a minor charged with driving under the influence of alcohol, previously convicted twice or more
  • a minor under 17 charged with an alcoholic beverage offense, previously convicted at least twice
• If under the age of 25 and charged with a moving violation, a driver’s safety course is required as a term of the deferred disposition

• Fee for Dismissal: The dismissal fee is $20 to $10, depending on the type of violation and proof provided. You will be notified of the fee after review.


• Documentation: Provide proof that you corrected the violation before the deadline. Examples include a renewed registration, valid driver’s license, or valid proof of insurance.


• Court Discretion: The court may deny the dismissal if proof is insufficient or the correction was not completed within the timeframe.
