RECOMMENDATION:

It is recommended that the City Council  authorize the execution of an Infrastructure Construction Agreement with the Fort Worth Zoological Association in an amount up to $646,751.00 for the installation and relocation of utilities associated with the development of the Elephant Springs Exhibit Phase II.

 
DISCUSSION:

The purpose of this Mayor and Council Communication (M&C) is to authorize the City Manager to execute an Infrastructure Construction Agreement (ICA) with the Fort Worth Zoological Association (Zoo Association) to provide for the installation and relocation of utilities associated with the development of the Elephant Springs Exhibit, Phase II project.

On May 4, 2010, (M&C C-24194) the City Council authorized a Management Agreement (Fort Worth Contract No. 40564) with the Zoo Association for the management, operation, and development of the Fort Worth Zoo.  Under the terms of the Management Agreement, Section 8.04, the City has the responsibility to relocate or alter basic utilities to accommodate any construction or modifications at the Zoo such as sanitary sewer, water, communications, gas, and electricity. 

On September 26, 2017 (M&C C-28408) the City Council authorized the execution of an ICA with the Zoo Association for $661,000.00 for the installation and relocation of utilities associated with the development of the Elephant Springs Exhibit Phase I.

The Elephant Springs Exhibit, Phase II ICA provides for the City to fund utility work estimated in an amount up to $646,751.00. The City will reimburse the Zoo Association for this ICA from the 2018 Bond Program which included funding for the design and construction of public utility infrastructure required to support the construction of new facilities at the City-owned Fort Worth Zoo.

Funds for this project are included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-05-2018).

The Fort Worth Zoo is located in COUNCIL DISTRICT 9 and is classified as a Special-Use Facility that serves on a City-wide and regional basis.

 

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that upon approval of the above recommendations, funds are available in the current capital budget, as appropriated of the 2018 Bond Program Fund.
