Authorize a Sole Source Agreement with Texas Excavation Safety Systems, Inc. d/b/a Texas 811 for Underground Construction One-Call Notification Center Services For The Water Department in an Annual Amount of $180,000.00 with Five (5) One-Year Renewal Options for the Same Annual Amount  (ALL COUNCIL DISTRICTS)  


RECOMMENDATION:

It is recommended that the City Council authorize an Agreement with Texas Excavation Safety Systems, Inc., d/b/aTexas 811 for underground construction one-call notification center services for the Water Department in an annual amount of $180,000.00 with five (5) one-year renewal options for the same annual amount. (ALL COUNCIL DISTRICTS)  

 
DISCUSSION:

Established under the Underground Facility Damage Prevention and Safety Act (Texas-1997), a "one-call" underground construction safety and underground facility damage prevention notification system provides excavators and other underground construction operators, such as those conducting underground boring activities, with the capability of making only one call prior to excavation, whereby all subscribing utility companies with underground lines in the area receive notice of a planned excavation.  An underground utility owner/operator is then given the opportunity to physically locate and mark the location of its underground lines, to help an excavator or underground construction operator avoid accidental damage.

The City of Fort Worth Water Department has utilized a one-call notification service since 2009.  Over the last 12 months, there have been 167,912 locate requests.  Previous purchases of this service were made utilizing a competitive solicitation with a best value analysis.  The City’s current vendor, Lone Star 811, has notified the City that it will cease operation in Texas on July 31, 2019, leaving Texas 811 as the sole provider in the state.  A one-month overlap of services from each vendor is required to train and validate all processes and settings, to ensure a successful transition. The City maintains over 7,000 miles of water mains and sewer mains.  Protecting this infrastructure from damage caused by excavation and underground construction activity is essential to public health and safety.   Utilizing a one-call notification center services has been beneficial in minimizing conflicts and associated damage to water and sewer assets from excavation and underground construction activity. 

BID ADVERTISEMENT - This procurement is exempt from the competitive bidding requirements as provided for under Section 252.022(7) of the Texas Local Government Code because Texas 811 is the sole provider of one-call notification center services in Texas.

PRICE ANALYSIS - The Water Department staff reviewed the proposed price and certified that it is fair and reasonable.

ADMINISTRATIVE CHANGE ORDER - An administrative change order or increase may be made by the City Manager up to the amount allowed by relevant law and the Fort Worth City Code and does not require specific City Council approval as long as sufficient funds have been appropriated

M/WBE OFFICE -  A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Purchasing Division and approved by the M/WBE Office, in accordance with the M/WBE or BDE Ordinance, because the M/WBE Waiver is based on the sole source information provided to the M/WBE Office by the Purchasing Division Buyer.

AGREEMENT TERMS - Upon City Council approval, this Agreement will Begin on July 1, 2019.

RENEWAL OPTIIONS -  This Agreement may be renewed for up to five (5) successive one-year terms at the City’s option.  This action does not require specific City Council approval provided that the City Council has appropriated sufficient fund to satisfy the City’s obligation during the renewal term.

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that upon approval of the recommendations, funds are available in the current operating budget, as appropriated, of the Water and Sewer Fund and that prior to an expenditure being made, the Water Department has the responsibility to validate the availability of funds.
