Authorize Execution of a Contract with FNH Construction, LLC., in the Amount of $1,140,827.50 for the 2019-5 CDBG Project Which Includes Street and Sidewalk Improvements in the Ash Crescent Neighborhood and on West Cantey Street in the South Hemphill Heights Neighborhood (COUNCIL DISTRICTS 8 and 9)


RECOMMENDATION:

It is recommended that the City Council:

1. Authorize the execution of a contract with FNH Construction, LLC., in the amount of $1,140,827.50 in Community Development Block Grant (CDBG) funds for the 2019-5 CDBG Project to include street and sidewalk improvements in the Ash Crescent Neighborhood and on West Cantey Street in the South Hemphill Heights Neighborhood which are in eligible low- and moderate-income neighborhoods (City Project Nos. 101785 and 100000); and

2. Authorize substitution of Action Plan funding years selected in order to achieve project goals.

 
DISCUSSION:

On August 7, 2018, through Mayor and Council Communication (M&C G-19328(Revised)), the City Council approved the City's 2018-2019 Annual Action Plan which included $776,855.80 in Community Development Block Grant (CDBG) funds for street and sidewalk improvements in the Ash Crescent Neighborhood Improvement Target Area. A public notice announcing the available funding and which street segments would see improvements ran in the Fort Worth Star-Telegram on April 22, 2019. A public comment period was held from April 22, 2019 to May 21, 2019.

A public notice published in the Fort Worth Star-Telegram on June 5, 2019, informed the public that $407,404.51 in CDBG funds previously set aside for the South Hemphill Heights Model Block was allocated for specific street and sidewalk improvements to the 700-900 blocks of W. Cantey Street located within the Model Block area. A public comment period is being held from June 5, 2019 to July 5, 2019.

Implementation of the project will result in the following improvements.

On March 21 and March 28, 2019, both the Ash Crescent Neighborhood and W. Cantey Street projects were advertised for bid together as the HMAC 2019-5 CDBG Street Rehabilitation Project in the Fort Worth Star-Telegram. On April 18, 2019, the following bids were received:

M/WBE Office - FNH Construction, LLC., is in compliance with the City's BDE Ordinance by committing to 13\% MBE participation on this project. The City's MBE goal on this project is 13\%. Additionally, FNH Construction, LLC is a certified M/WBE firm.. 

Staff recommends that the City Council authorize award a contract to FNH Construction, LLC., in the amount of $1,140,827.50, which is consistent with the bid amount, for the Ash Crescent and West Cantey Street Improvements Project. The City will use an additional $246,915.52 for inspections, testing and advertising/printing for a total project amount of $1,387,743.02. The total amount allocated for this project is $1,387,743.02 and any remaining funds may be used for approved change orders. This funding requires Interdepartmental Letters of Agreement pursuant to applicable laws and regulations governing the use of federal grant funds.

The streets recommended for reconstruction are in COUNCIL DISTRICTS 8 and 9, Mapsco 76V, 77R, 77V, and 77Z .

The Director of Finance certifies that funds are available in the Grants Operating Federal Fund.
