COUNCIL ACTION:  Approved on 5/21/2019

DATE: 5/21/2019 REFERENCE NO.: **P-12329 LOG NAME: 13PZERO TURN MOWER RENTALS CC PARD
CODE: P TYPE: CONSENT PUBLIC HEARING: NO
SUBJECT:

Authorize Amendment to an Existing Purchase Agreement with Zimmerer Kubota & Equipment, Inc., for Zero Turn Mower Rentals and Parts Using a Cooperative Contract for the Park and Recreation Department to Increase the Amount by $100,000.00 for a New Annual Amount Up to $200,000.00 (ALL COUNCIL DISTRICTS)

RECOMMENDATION:

It is recommended that the City Council authorize an amendment to an existing purchase agreement with Zimmerer Kubota & Equipment, Inc., for zero turn mower rentals and  parts using Choice Partners Cooperative Contract  17/052CG-12 for the Park and Recreation Department to increase the existing purchase Agreement amount by $100,000.00 for a new annual amount up to $200,000.00 and authorize three annual renewal options.

DISCUSSION:

On July 2018, the Public Events Department submitted a request to rent tractors using Choice Partner Contract No. 17/052CG-12. The Park and Recreation Department (PARD) was later added to the agreement to rent zero turn mowers and parts. In 2019, PARD anticipates spending approximately $70,000.00 to rent additional zero turn mowers to assist with ground maintenance through the City. The remaining amount of $30,000.00 is requested to ensure that funds are available for additional rentals.

COOPERATIVE PURCHASE - The Purchasing Division will use Choice Partner Contract No. 17/052CG-12 to rent equipment and purchase items as allowed. State law provides that a local government purchasing an item under a Cooperative Purchasing Agreement satisfies state laws requiring that the local government to seek competitive bids for purchase of the items.  Choice Partner contracts have been competitively bid to increase and simplify the purchasing power of government entities.

M/WBE OFFICE -  M/WBE goal is not assigned when purchasing from an approved purchasing cooperative or other public entity.

AGREEMENT TERMS - The current term of this Agreement will expire on November 28, 2019.

RENEWAL OPTIONS - The Agreement may be renewed at the City's option for three additional one-year terms if Choice Partner renews its contract.  This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term.  Staff anticipates that the costs for renewal years shall remain approximately the same as the first year.

FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that funds are available in the current operating budgets, as appropriated, of the participating departments and that prior to an expenditure being made, the department has the responsibility to validate the availability of funds.
