SUBJECT:   Rescind M&C C-28985 Awarding a Contract to Joe Funk Construction, Inc., and Authorize Execution of a Contract with Gibson & Associates, Inc., in the Amount of $468,060.00 for Bridge Rehabilitation (2018-2) on Four Bridges in Two Locations (COUNCIL DISTRICTS 4 and 7)

RECOMMENDATION:

It is recommended that the City Council:

  1. Rescind M&C C-28985, authorizing execution of contract with Joe Funk Construction, Inc., for Bridge Rehabilitation (2018-2) on four bridges in two locations; and

  2. Authorize execution of a contract with Gibson & Associates, Inc., in the amount of $468,060.00 for Bridge Rehabilitation (2018-2) on four bridges in two locations.
 
DISCUSSION:

On January 15, 2019 the City Council authorized (M&C C-28985) awarding a contract to Joe Funk Construction, Inc., in an amount of $359,846.00.

Prior to contract execution Joe Funk Construction, Inc., notified staff that it could not construct the project as bid because its work plan and cost estimate are not adequate to accomplish required scope of work. As a result Transportation and Public Works Department informed Joe Funk Construction, Inc., of its intent to make a claim against the bid bond for an amount equivalent to 5% of the amount bid which is $17,992.30.

Staff has confirmed that second low bidder Gibson & Associates, Inc., can perform this project at its bid amount $468,060.00 which staff considers fair and reasonable.

This project was advertised for bid on September 20, 2018 and September 27, 2018 in the Fort Worth Star-Telegram. On October 18, 2018, the following bids were received:

The City reserves the right to increase or decrease quantities of individual pay items within the contract provided that the total contract amount remains within plus or minus 25 percent of the contract award.

M/WBE OFFICE: Gibson & Associates, Inc., is in compliance with the City's BDE Ordinance by committing to 19% MBE participation on this project. The City's MBE goal on this project is 10%.

This project is located in COUNCIL DISTRICTS 4 and 7.

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that, upon approval of the above recommendations, funds are available in the General Capital Projects fund as previously appropriated. Prior to an expenditure being incurred, the participating department has the responsibility to validate the availability of funds.
