On April 7, 2015, the City Council approved entering into a contract with Century Fire Protection, LLC. for fire alarm services (M&C P-11745). Under the contract, goods and services to be ordered include new installation, modifications/upgrades, testing, inspections, maintenance and repairs. The contract was set at an estimated amount of up to $300,000.00 annually. The contract also contains four one one-year renewal options; currently, the contract is in the third renewal term which will end on April 7, 2019. The contract was entered into following an Invitation to Bid process based on individual unit prices. This M&C to increase the spending authority is required under Section 2-9 of the City Code and state law. The increase in spending authority is not considered a change order pursuant to Section 252.048 of the Texas Local Government Code because the individual unit prices are not being increased. The original spending amount, $300,000.00, was based on estimated quantities of goods and services, but the City reserved the right to order the actual quanities needed at the same unit price, which is what this M&C authorizes. Because of the City's increased fire alarm services needs, staff recommends amending the contract to increase the annual amount up to $400,000.00. As in the original agreements, the contract does not guarantee that a specific amount of services will be purchased, however the amendment would allow City Departments to spend up to $400,000.00 annually so long as sufficient funds have been appropriated. |
