SUBJECT:   Conduct Public Hearing and Authorize Use of a Portion of Parkland at Trinity Park for the Installation of Public Sewer and Water Main with Associated Infrastructure (COUNCIL DISTRICT 9)

RECOMMENDATION:

It is recommended that the City Council:

1.  Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter
     26, Protection of Public Parks and Recreational Lands;
  
2.  Find that no feasible or prudent alternative exists for the use of Trinity Park for the installation of public
     sewer and water main with associated infrastructure;
  
3.  Find that the proposed installation of the public sewer and water main with associated infrastructure
     includes all reasonable planning to minimize harm to the parkland, including that all infrastructure and
     equipment will be constructed in Trinity Park as specified on the attached exhibits and as noted in the
     discussion below;  and

4.  Close the public hearing and authorize use of approximately 1.05 acres of dedicated parkland at Trinity
     Park for the proposed public sewer and water main with associated infrastructure.

        *  Trinity Park -  located at 2401 University Drive, southwest of the Clear Fork Trinity River, south access IH 30 West, east of University Drive, intersected by Crestline Road, south of terminus of Foch Street, intersected by Lancaster Avenue, east of Museum Way, south of 7th Street, in Council District 9.

 
DISCUSSION:

The purpose of this Mayor and Council Communication (M&C) is to authorize the use of a portion of parkland at Trinity Park for the installation of public sewer and water main with associated infrastructure improvements.

The Park & Recreation Department (PARD) has been approached by the City of Fort Worth Water Department (WD) requesting the use of parkland at Trinity Park (Park) for the installation of a public sewer and water main with associated infrastructure.

The WD is requesting to install a public sewer and water main in order to address increased demands and capacity for the Dickies Arena and the Cultural District. The line will be installed in two phases. The first phase will be installed in the existing Crestline Road in coordination with the work associated with the Trail Drive Project. The work is scheduled to begin in February and end by March 2019, prior to Mayfest. This will allow for the removal of Crestline Road and allow for the construction of the Phase 2B Trail Drive Realignment Project.  Phase 2B Trail Drive Realignment Project includes the construction of a new parking lot for Van Zandt Cottage, park trails and landscaping, and is scheduled to start in December 2018. The final segment of the Phase 2B project will begin in June 2019 and will be completed before Mayfest 2020. Included in the project are pavement improvements to Trinity Park Drive.

The proposed sewer and water main will be installed at a depth ranging from 5 feet to 15 feet.  The proposed project will encompass approximately 45,857 square feet of water maintenance area.

Additionally, the WD has requested the use of 81,203.00 square feet of parkland to serve as a temporary workspace in connection with the construction of the proposed sewer and water main.  At the completion of the work the park will be returned to previous or better condition.

No trees will be removed as a part of the proposed construction.  The existing trees in proximity to the proposed construction will be protected using chain link fencing throughout construction.

In accordance with the Texas Parks and Wildlife Code, Chapter 26, the City of Fort Worth seeks to use a portion of the parkland for the purpose of installing a public sewer and water main with associated infrastructure improvements.

On October 24, 2018, the Park & Recreation Advisory Board endorsed Staff's recommendation to the City Council to authorize the use of Trinity Park for the installation of public sewer and water main with associated infrastructure.

In accordance with State law, public notice of the hearing was advertised in the Fort Worth Star-Telegram on November 15, 2018, November 22, 2018 and November 29, 2018.  An exhibit map was available for public review at the Park & Recreation Department administrative offices located at 4200 South Freeway, Suite 2200, Fort Worth, Texas 76115.

A letter announcing the proposed use was sent to the president of the Alamo Heights, Arlington Heights, Sunset Terrace and SO7 Townhomes Neighborhood Associations and Montgomery Plaza Residential Condominiums Association on November 12, 2018. Signage was posted at the site noting the proposed use and providing instructions for directing comments to the Park & Recreation Department.  Staff will note any public comment received during the public hearing Report of City Staff.  

Trinity Park is located in COUNCIL DISTRICT 9.  

This M&C does not request approval of a contract with a business entity.
