RECOMMENDATION:

It is recommended that the City Council authorize execution of a Community Facilities Agreement with Forestar (USA) Real Estate Group Inc. with City participation in an amount not to exceed $655,037.44 for the construction and oversizing of segments of a total of 14,935 linear feet of sewer main in the vicinity of Old Blue Mound Road and South of HWY 114 in the City of Fort Worth and its ETJ.

 
DISCUSSION:

Forestar (USA) Real Estate Group Inc. (Developer) is constructing the Brookfield development in Fort Worth's ETJ. A 14,935 linear foot sewer line extension is required to provide sewer service to the development. The City of Fort Worth is cost participating in the oversizing of this sewer line in order to serve anticipated future development in the surrounding area. The City's cost participation in the construction of the sewer main is estimated to be $655,037.44 as shown in the table below.

Staff recommends execution of a Community Facilities Agreement with the Developer, with City participation, to construct the project to its ultimate configuration in order to have the capacity to serve future City of Fort Worth residents and businesses.

The costs stated herein are based upon 2010 CFA unit prices. The reimbursement of the participation, excluding inspection and material testing fees, is not a lump-sum amount and may be less than stated above depending upon actual quantities from the Notice of Final Completion Package, commonly referred to as the Green Sheet Package. The work is anticipated to begin after the approval of this M&C.

In accordance with Chapter 212, Subchapter C of the Texas Local Government Code, the City's participation in the contract is exempt from competitive bidding requirements because the contract is for oversizing public improvements being constructed by the developer, the developer will execute a performance bond to cover the total project cost including all of the City's cost participation, and the City's cost participation will be determined in accordance with the City's CFA unit price ordinances.

This project is located in City of Fort Worth and its ETJ (COUNCIL DISTRICT 7).  

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that upon approval of the above recommendation funds will be available in the Water and Sewer 2017A Bond Funds. The Water and Sewer Bond 2017A CFA Programmable Project P00001 includes an appropriation of $6,708,362.00 for the city participation on developer capital projects. After the funding of this M&C, $6,053,324.00, of the appropriation will be available to fund future individual projects.
