Authorize Execution of a Community Facilities Agreement with Uplift Education with City Participation in an Amount Not to Exceed $353,603.66 for Oversizing an 8-Inch Sewer Main to a 15-Inch Sewer Main, an 8-Inch Sewer Main to a 12-Inch Sewer Main and a 12-Inch Water Main to a 16-Inch Water Main in the Vicinity of Chapin Road in the City of Fort Worth to Serve Anticipated Future Development in the Surrounding Area (COUNCIL DISTRICT 3)


RECOMMENDATION:

It is recommended that the City Council authorize execution of a Community Facilities Agreement with Uplift Education with City participation in an amount not to exceed $353,603.66 for oversizing an 8-Inch sewer main to a 15-Inch sewer main, an 8-inch sewer main to a 12-inch sewer main and a 12-inch water main to a 16-inch water main in the vicinity of Chapin Road in the City of Fort Worth to serve anticipated future development in the surrounding area.

 
DISCUSSION:

Uplift Education (Developer) is constructing the Uplift Charter School development in the Fort Worth City limits. The development requires an 8-inch sewer main and a 12-inch water main to serve the site. The City of Fort Worth is cost participating in oversizing the following:

(1) 4,243 linear feet of the offsite 8-inch sewer main installed by the developer of Palmilla Springs Phase 4 located north of W. IH 30 to a 15-inch line;
(2) 536 linear feet of the 8-inch sewer main located west along Chapin Road to a 12-inch sewer main; and
(3) 978 linear feet of the 12-inch water main located west along Chapin Road to a 6-inch water main.  

The City desires to oversize the lines to serve anticipated future development in the surrounding area. The oversized lines will serve residents within the City. The City's cost participation in the construction of the water and sewer mains is estimated to be $353,603.66 as shown in the table below:

Staff recommends execution of a Community Facilities Agreement with the Developer, with City participation, to construct the project to its ultimate configuration.

The costs stated herein are based upon City Council approved CFA unit prices rather than public bid cost. The reimbursement of the participation, excluding inspection and material testing fees, is not a lump-sum amount and may be less than stated above depending upon actual quantities from the Notice of Final Completion Package, commonly referred to as the Green Sheet Package. The work is anticipated to begin after the approval of this M&C.

In accordance with Chapter 212, Subchapter C of the Texas Local Government Code, the City's participation in the contract is exempt from competitive bidding requirements because the contract is for oversizing public improvements being constructed by a developer and the developer will execute a performance bond to ensure completion of the project.

This project is located in City of Fort Worth (COUNCIL DISTRICT 3).  

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Financial certifies that upon approval of the above recommendation funds will be available in the Water and Sewer 2017A Bond Funds. The Water and Sewer Bond 2017A CFA Programmable Project P00001 includes an appropriation of $7,332,183.00 for the city participation on developer capital projects. After the funding of this M&C, $6,978,578.00, of the appropriation will be available to fund future individual projects.
