SUBJECT:   Conduct Public Hearing and Authorize Use of a Portion of Parkland at Greenbriar Park for the Installation of Public Sanitary Sewer and Water Service Lines and Associated Infrastructure for the Park & Recreation Department Maintenance Service Center (COUNCIL DISTRICT 9)

RECOMMENDATION:

It is recommended that the City Council:

1.  Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands;
  
2.  Find that no feasible or prudent alternative exists for the use of Greenbriar Park for the installation of public sanitary sewer and water service lines and associated infrastructure;
  
3.  Find that the proposed installation of the public sanitary sewer and water service lines and associated infrastructure includes all reasonable planning to minimize harm to the parkland, including that all infrastructure and equipment will be constructed in Greenbriar Park as specified on the attached exhibits and as noted in the discussion below;  and

4.  Close the public hearing and authorize use of approximately 5.067 acres of dedicated parkland at Greenbriar Park for the proposed public sanitary sewer and water service lines and associated infrastructure.

        *  Greenbriar Park- located at 5200 Hemphill Street, west of Hemphill Street, north of Sharondale Street and east of James Ave, in Council District 9.

 
DISCUSSION:

The purpose of this Mayor and Council Communication (M&C) is to authorize the proposed use of a portion of parkland at Greenbriar Park for the installation of public sanitary sewer and water service lines and associated infrastructure improvements for the Park & Recreation Department (PARD) Maintenance Service Center project.

The City is requesting authorization to install a new public 8-inch water line and will be connecting a 6-inch sewer line to the existing 18-inch sewer main. During the development of the plans for the facility it was discovered that the City of Fort Worth Water Department did not have an easement for the existing 18-inch sewer main that runs within the park. A maintenance area is being provided as part of this proposal. The utilities are necessary to provide services to the new park maintenance service center. The location of the proposed improvements were chosen in order to minimize the impact to the Park (see attached exhibit). The proposed project will encompass approximately 220,730.00 square feet of maintenance area.

The PARD is working with the City Forester on minimizing tree impacts for the project. A total assessment of those impacts will be determined by the City Forester. The existing trees in proximity to the proposed construction will be protected using chain link fencing throughout construction. Construction is anticipated to start August 8, 2018 and be completed April 30, 2020.

On December 12, 2017, (M&C C-28518) the City Council authorized a Construction Manager at Risk Contract with Thomas S. Byrne Construction Services for the construction of Phase I Improvements funded by tax notes in the amount of $10,000,000.00 (M&C G-19009). The 2018 Bond Program included $11,100,000.00 for Phase II of the Park maintenance service center. It is anticipated that the entire project will be completed during Fiscal Year 2020 (Informal Report No.10160).

On July 25, 2018, the Park & Recreation Advisory Board endorsed Staff's recommendation to the City Council to authorize the use of a portion of the park for the installation of public sanitary sewer and water service lines and associated infrastructure.

In accordance with State law, public notice of the hearing was advertised in the Fort Worth Star-Telegram on August 16, 2018, August 23, 2018 and August 30, 2018.  An exhibit map was available for public review at the Park & Recreation Department administrative offices located at 4200 South Freeway, Suite 2200, Fort Worth, Texas 76115.

A letter announcing the proposed use was sent to the president of the North Greenbriar Neighborhood Association on August 10, 2018.  Signage was posted at the site noting the proposed use and providing instructions for directing comments to the Park & Recreation Department.  Staff will note any public comment received during the public hearing Report of City Staff.  

Greenbriar Park is located in COUNCIL DISTRICT 9.  

This M&C does not request approval of a contract with a business entity.
