SUBJECT:   Conduct Public Benefit Hearing to Declare the Sufficiency of a Petition Requesting the Establishment of Fort Worth Public Improvement District No. 19 (Historic Camp Bowie) and Adopt a Resolution Authorizing and Establishing the Historic Camp Bowie Public Improvement District (COUNCIL DISTRICTS 3 and 7)

RECOMMENDATION:

It is recommended that the City Council:

1. Conduct a public benefit hearing concerning the sufficiency of a petition requesting establishment of Fort Worth Public Improvement District No. 19 (Historic Camp Bowie) and the establishment of the Historic Camp Bowie PID;

2. Find that the petition requesting establishment of the Historic Camp Bowie PID meets the requirements necessary to designate the proposed area as a Public Improvement District pursuant to Chapter 372 of the Texas Local Government Code;

3. Adopt the attached Resolution: (i) making certain findings concerning the nature and advisability of special improvements and services to be provided for properties in the Historic Camp Bowie PID, the estimated costs of such improvements and services, the method of assessment, the boundaries of the Historic Camp Bowie PID, the apportionment of costs between the Historic Camp Bowie PID and the City, as a whole, and (ii) authorizing and establishing the Historic Camp Bowie PID; and

4. Direct the City Secretary to publish notice of the establishment of the Historic Camp Bowie PID as required by Chapter 372 of the Texas Local Government Code.

 
DISCUSSION:

On June 8, 2018, the City staff received a petition requesting establishment of Fort Worth Public Improvement District No. 19 (Historic Camp Bowie) (PID), which is proposed to include approximately 238.76 acres of land generally consisting of: all commercial land use areas along the Camp Bowie Blvd. corridor from Montgomery (on the east) to Irene (on the west); all commercial land use areas along W. 7th Street from University to Montgomery.

PID 8 (Camp Bowie PID) is currently set to expire on or about January 7, 2019 and the petitioners desire to establish a new public improvement district with adjustments to the boundaries based upon property owners' requests. The proposed Historic Camp Bowie PID is being created to provide many of the same or similar improvements and services currently being provided to property owners within the boundaries of the existing PID 8. If the proposed Historic Camp Bowie PID is established, then portions of the two PIDs will overlap for about three months until the expiration of PID 8. Staff intends on recommending to City Council that the existing PID 8 be allowed to expire on its own terms and that the properties within it be levied an assessment of $0.00 for the remaining term. Assuming City Council establishes this new Historic Camp Bowie PID, any properties within the boundaries of the proposed Historic Camp Bowie PID will only be required to pay an assessment as part of the newly proposed PID, not PID 8. PID 8 will have a fund balance of approximately $197,800.00, which is all attributable to prior assessments from property that is east of Irene Street and within the boundaries of the new Historic Camp Bowie PID.  To ensure that the prior assessments continue to confer a special benefit on those properties that were subject to the same, the full remaining fund balance is expected to be transferred to the Historic Camp Bowie PID to be expended on improvements and/or services within its boundaries.  

The above-stated petition complies with Section 372.005 of the Texas Local Government Code and, as of July 20, 2018, has been signed by record owners of taxable real property liable for assessment under the proposal who constitute: (a) 50.3% of the appraised value of taxable real property liable for assessment under the proposal set forth in the petition, as determined by the current roll of the Tarrant Appraisal District and (b) 54% of the area of all taxable real property that is liable for assessment under the proposal and (c) 56% of all record owners of property that is liable for assessment under the proposal.

The goal of the Historic Camp Bowie PID is to ensure that the Camp Bowie Boulevard corridor will continue to be economically successful by providing commercial services, neighborhood shopping, and neighborhood services. The general nature of the proposed improvements and services to be provided include, without limitation, landscaping, promotional sign and banner programs, capital improvements, communication programs, cooperative programs, liter abatement programs, and special supplemental services for improvement and promotion of the Historic Camp Bowie PID.

The estimated costs of the proposed improvements and services to be provided in the Historic Camp Bowie PID for fiscal year 2018-2019 (October 1 – September 30) is $604,730.00. The estimated cost of the same to be provided in subsequent years will be subject to future annual budget and service plans adopted by the City Council. The entire costs of each improvement and service will be paid from the above-stated assessments and no City funds will be used to pay any portion of such costs, unless such funding is approved by the City Council on a case-by-case basis. Assessments will begin on October 1, 2018.

Staff recommends that the City Council find that the improvements and services are advisable because they will promote the interests of the City and confer special benefits on the assessed properties within the Historic Camp Bowie PID.  

Upon the close of the public hearing, staff recommends that the City Council declare the petition to establish the Historic Camp Bowie PID to be sufficient and adopt the attached Resolution making certain finding concerning the following and establishing the Historic Camp Bowie PID:

        • The advisability of establishing the proposed Historic Camp Bowie PID;
        
        • The general nature of the proposed improvements and services;
        
        • The estimated costs of the improvements and services;
        
        • The boundaries of the Historic Camp Bowie PID;
        
        • The proposed method of assessment; and
        
        • The apportionment of costs between the Historic Camp Bowie PID and the City, as a whole.

Upon adoption of the Resolution, the Historic Camp Bowie PID will become effective on the date the City Council's authorization to establish the PID has been published in a newspaper of general circulation and will remain in effect through September 30, 2028 or until earlier dissolved.

The City intends on entering into a management services agreement with Camp Bowie District, Inc. to manage the day-to-day affairs of the Historic Camp Bowie PID, which contract will be addressed in a separate, but related, M&C authorizing the assessment.

The proposed PID 19 is located in COUNCIL DISTRICTS 3 and 7.

This M&C does not request approval of a contract with a business entity.
