SUBJECT:  

Adopt Ordinance Vacating a Portion of Beckham Place and Authorize Sale of a Portion of the Beckham Place Right-of-Way That is City-Owned Surplus Property Between Block 2 Mistletoe Heights Addition and Block 3R Frisco Heights Addition to be Replatted with the Adjoining Property for a New Multi-Family Development in the Near Southside (COUNCIL DISTRICT 9)


RECOMMENDATION:

It is recommended that the City Council:

1.  Adopt the attached ordinance vacating a portion of Beckham Place between block 2 Mistletoe Heights Addition and block 3R Frisco Heights Addition to be replatted with the adjoining property for a new multi-family development in the Near Southside; and

2.   Authorize the sale of a portion of the Beckham Place right-of-way that is City-owned surplus property for a total sales price of $6,000.00, in accordance with Section 272.001(b)(1) of the Texas Local Government Code;  and  

3.   Authorize the City Manager or his designee to record the appropriate instrument conveying the property to complete the sale; and  

4.  Waive any and all purchase fee value of the remainder of the vacated right-of-way in accordance with City policy.

 
DISCUSSION:

Halff and Associates, LLC, on behalf of Mistletoe LLC, has requested vacation of this portion of Beckham Place to be replatted with the adjoining property for a new multi-family development in the Near Southside. The City Plan Commission recommended approval of this request at its meeting on April 25, 2018.  An acceptable final plat (FP-18-037) has been received in accordance with the Subdivision Ordinance.

The City of Fort Worth (City) originally obtained the large portion of the above mentioned right-of-way through plat dedication (as shown in red on attached vicinity map). The City does not own any fee interest in this portion of the right-of-way. The City does own property adjacent to the right-of-way and did expend City funds to purchase the portion of the right-of-way easement (as shown in blue on attached vicinity map).  In accordance with the City's policy regarding street and alley  vacation transactions approved by the City Council on March 6, 2007, (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of the portion of the right-of-way easement for the street acquired through plat dedication. However, a small tract containing approximately 2,135 square feet of land was received via deed in 1960 for use as public right-of-way. Upon approval of the vacation of public right-of-way, a deed without warranty will be executed conveying the City's fee owned interest in 2,135 square feet land being abandoned as public right-of-way, subject to the reservation of utility easements. The purchaser will pay $6,000.00 in fair market value for the property.

This project is located in COUNCIL DISTRICT 9.

This M&C does not request approval of a contract with a business entity.
 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that the Property Management Department will be responsible for the collection and deposit of funds due to the City.  The sale and abatement of property contemplated under this proposal will be reflected on the City's balance sheet once approved.
