Authorize Execution of Two Encroachment Agreements with Sinclair Holdings LLC for the Construction of a Skybridge Over the Public Alleyway between 4th Street and 5th Street and a Pedestrian Tunnel Under the Public Right-of-Way in the 500 Block of Main Street (COUNCIL DISTRICT 9)


RECOMMENDATION:

It is recommended that the City Council authorize the execution of two Encroachment Agreements with Sinclair Holdings LLC for the construction of a skybridge over the public alleyway between 4th Street and 5th Street and a pedestrian tunnel under the public right-of-way in the 500 block of Main Street.

 
DISCUSSION:

Sinclair Holdings LLC has requested an Encroachment Agreement to allow for the construction of a skybridge which encroaches over the public right-of-way in the 500 block of Main Street. The proposed skybridge will connect the Sanger Building to the Sinclair Building. In addition, Sinclair Holdings LLC has requested an Encroachment Agreement to allow construction of a pedestrian tunnel which encroaches under the public right-of-way in the 500 block of Main Street. The purpose of the pedestrian tunnel is to connect the Sanger Building to the Sinclair Building to provide access for a restaurant in the Sinclair building.

The Encroachment Committee, consisting of staff from the Transportation and Public Works Department, the Water Department, and the Planning and Development Department have reviewed and approved these encroachment requests. The Downtown Design Review Board reviewed the projects on October 7, 2016 and supports the construction of the skybridge and pedestrian tunnel. The application fee for the encroachment granted by this Agreement will be $575.00 for each agreement. The term of the Agreement will be 30 years with an annual license fee of $.56 per square foot of encroachment. The annual fee for the skybridge will be $146.72 and $44.80 for the pedestrian tunnel.

The application fee for each agreement and the first year of encroachment fees have been paid in full on both agreements.

FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that upon approval of the above recommendation the Planning and Development Department is responsible for the collection and deposit of funds due to the City.
