Authorize Execution of Amendment to Extend the Term of the Lease with Barket Corporation, d/b/a McCart Village for the Fort Worth Police Department Patrol Facility Located at 7650 McCart Avenue, Fort Worth, Texas (COUNCIL DISTRICT 6)


RECOMMENDATION:

It is recommended that the City Council authorize the execution of an amendment to extend the term of the lease with Barket Corporation, d/b/a McCart Village (City Secretary Contract No. 37785) for the Fort Worth Police Department patrol facility located at 7650 McCart Avenue, Fort Worth, TX 76133 for a term of two (2) years with three (3) one year renewals at a rental rate of $6,784.61 per month for year one with a 3% increase in rent starting the second year and each one year renewal.

 
DISCUSSION:

On July 8, 2008, Mayor and Council Communication (M&C C-22891) City Council approved a Lease Agreement between the City of Fort Worth (City) and JPMCC2005-CIBC13 McCart Avenue (Lessor) to lease approximately 6,587 square feet of space located at 7650 MCart Avenue to be used by the Fort Worth Police Department as a storefront. Since 2008, this lease has been assigned to various entities and is currently between the City and Barket Corporation, d/b/a McCart.

The Lease Agreement (as amended by subsequent renewals, modifications and assignments) has a current rental rate of $6,587.00 per month and terminates September 30, 2018.

The City and Lessor desire to extend the current lease for two (2) years and add three (3) one year renewal options at the following rental rates:

October 1, 2018 - September 30, 2019$6,784.61
October 1, 2019 - September 30, 2020$6,988.15
October 1, 2020 - September 30, 2021$7,197.79
October 1, 2021 - September 30, 2022$7,413.72
October 2, 2022 - September 30, 2023$7,636.14

FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that funds are available in the General Fund, Police Department cost center for this purpose.  Prior to an expenditure being incurred, the Police Department has the responsibility to verify the availability of funds.  Future year appropriations are subject to Mayor and Council approval.
