SUBJECT: | Adopt Ordinance Vacating Shire Meadow Drive to Accommodate a New Large Grocery Store Development and Surrounding Pad Sites for Cencor Acquisition Company, Inc. (COUNCIL DISTRICT 7) |
RECOMMENDATION: |
It is recommended that the City Council: 1. Adopt the attached ordinance vacating Shire Meadow Drive to accommodate a new large grocery store development and surrounding retail pad sites for Cencor Acquisition Company, Inc.; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy. |
DISCUSSION: |
Cates-Clark and Associates, LLP, on behalf of Cencor Acquisition Company, Inc., has requested the vacation of a portion of Shire Meadow Drive. Cates-Clark and Associates proposes to vacate the current alignment of Shire Meadow Drive and dedicate a new alignment by plat of Shire Meadow Drive to the east to accommodate a new large grocery store development and surrounding retail pad sites. The City Plan Commission recommended approval of this request at its meeting on May 27, 2015. An acceptable final plat (FP-15-074) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through dedication of a right-of-way easement by separate instrument. The City does not own any fee interest in the right-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easement. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007, (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of these right-of-way easementsfor the street. This project is located in COUNCIL DISTRICT 7. This M&C does not request approval of a contract with a business entity. |
