COUNCIL ACTION:  Approved on 5/15/2018 - Ordinance No. 23217-05-2018

DATE: 5/15/2018 REFERENCE NO.: **PZ-3160 LOG NAME: 0665030 VA-12-005, VA-12-006 AND VA-12-007
CODE: PZ TYPE: CONSENT PUBLIC HEARING: NO
SUBJECT:

Adopt Ordinance Vacating Portions of Prescriptive Right-of-Way for Old Granbury Road and Columbus Trail Near the Intersection of Sycamore School Road and Summer Creek Drive for a Proposed Mixed-Use Development  (COUNCIL DISTRICT 6)

RECOMMENDATION:

It is recommended that the City Council:

1. Adopt the attached ordinance vacating portions of prescriptive right-of-way for Old Granbury Road and Columbus Trail near the intersection of Sycamore School Road and Summer Creek Drive for a proposed mixed-use development; and

2. Waive any and all purchase fee value of the vacated land in accordance with City policy.

DISCUSSION:

Dunaway Associates, on behalf of Legacy Capital Company, has requested vacation of these portions of prescriptive right-of-way for Old Granbury Road and Columbus Trail to be replatted with the adjoining property for a proposed mixed-use development. The City Plan Commission recommended approval of this request at its meeting on May 23, 2012.  An acceptable final plat (FP-15-125) has been received in accordance with the Subdivision Ordinance.

The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through prescription. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements.  In accordance with the City's policy regarding street and alley  vacation transactions approved by the City Council on March 6, 2007, (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of these right-of-way easements for the streets.

This project is located in COUNCIL DISTRICT 6.

This M&C does not request approval of a contract with a business entity.

FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
