RECOMMENDATION:

It is recommended that the City Council authorize execution of an Assignment Agreement in an amount up to $402,947.73 with Riverbend Investment, Ltd., for Engineering, Landscape and Environmental Services to be provided by Halff Associates, Inc., for Phase 1 of the Trinity Trails East Fort Worth Project.

 
DISCUSSION:

The purpose of this Mayor and Council Communication (M&C) is to authorize execution of an Assignment Agreement in an amount up to $402,947.73 with Riverbend Investment, Ltd., for Engineering, Landscape and Environmental Services to be provided  by Halff Associates, Inc., for Phase 1 of the Trinity Trails East Fort Worth Project.

This Agreement amount reflects compensation paid to Halff Associates, Inc., by Riverbend Investment, Ltd., for services rendered for the design phase of the Trinity Trails East Fort Worth Project. The City intends to continue the Agreement with Halff Associates, Inc., through its completion. The City may amend the Agreement to add additional services necessary for the Trinity Trails East Fort Worth project beyond the original project scope.

The East Fort Worth Trail Extension Project provides an off-street trail connection from Handley Ederville Road to River Trails Park. The ultimate goal is to continue this trail to the River Legacy trail in the City of Arlington. Additionally, this connection will create off-street access for numerous neighborhoods in the area and will also provide access to River Trails Park.

On September 29, 2015, (M&C G-18585) the City Council authorized the City Manager to execute an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) for the Transportation Alternatives Program (TAP) - East Fort Worth Trail Extension Project (City Secretary Contract (CSC) No. 47147) in the amount of $2,934,926.00.  In addition to the grant funds, this project includes funding from the 2014 Bond Program in the amount of $914,116.00.

In order to expedite the delivery of Phase 1 of the Trinity Trails East Fort Worth Project, Riverbend Investments, Ltd., the major landowner through which this portion of the trails are to traverse, contracted with Halff Associates, Inc., to prepare the engineering, landscape and environmental documentation required for this project. Upon TxDOT's approval of the environmental documentation and the engineering plans, the project was advertised by the City for construction.

On December 12, 2017, (M&C C-28519) the City Council authorized the award and execution of a construction contract with 2L Construction, LLC, for the construction of Phase 1 of the Trinity Trails East Fort Worth Project.

In order to obtain ownership of the design and engineering project documents and to retain all the functions of Halff Associates, Inc., for administration of the Project, the Park & Recreation Department recommends acquiring the Engineering Agreement from Riverbend Investment, Ltd.  Staff has reviewed the scope, fee, terms, work product and schedule for the Agreement and find them to be fair and reasonable.

Project location is in COUNCIL DISTRICTS 4 and 5.

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that funds are available in the current capital budget, as appropriated, of the 2014 Bond Program, East Fort Worth Trail Extension Project. The Park & Recreation Department has the responsibility to validate the availability of funds prior to an expenditure being incurred.
