Authorize Agreement with Praxair Distribution, Inc., for Gases for City Departments in an Annual Amount Up to $150,000.00 and Authorize Four Annual Renewal Options (ALL COUNCIL DISTRICTS)


RECOMMENDATION:

It is recommended that the City Council Authorize an Agreement with Praxair Distribution, Inc., for gases for City Departments in an annual amount Up to $150,000.00 and authorize four annual renewal options.

 
DISCUSSION:

Purchasing initiated an Invitation to Bid (ITB) for an Agreement to procure different types of gas such as industrial, laboratory, compressed and medical gases for City departments to use for welding, maintaining equipment and cutting metal for projects.  The ITB consisted of detailed specifications listing the type of gases, cylinder sizes and delivery requirements.  

The Bid was advertised in the Fort Worth Star-Telegram on November 22, 2017, November 29, 2017 and December 6, 2017.  The City received one bid.

Staff recommends awarding a one-year contract to Praxair Distribution, Inc., with four one-year options to renew.  The contract price for the goods per year would be $150,000.00; however, the proposed contract would allow the unit price to be increased so long as the City approves.  In addition, an administrative change order or increase may be made by the City Manager in the amount up to $37,500.00 and does not require specific City Council approval as long as sufficient funds have been appropriated.

M/WBE OFFICE - A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Purchasing Division and approved by the M/WBE Office, in accordance with the BDE Ordinance, because the purchase of goods or services is from sources where subcontracting or supplier opportunities are negligible.

RENEWAL OPTIONS - This Agreement may be renewed for up to four additional one-year terms at the City's option.  This action does not require specific City Council approval provided that the City Council has appropriated sufficient funds to satisfy the City's obligations during the renewal term.  Staff anticipates that the costs for renewal years shall remain approximately the same as the first year.

This Agreement shall begin upon City Council approval and shall end one year from that date.


 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that funds are available in the current operating budget, as appropriated, of the participating departments.  Prior to an expense / expenditure being incurred, the participating department has the responsibility to validate the availability of funds.
