SUBJECT: | Deny Developer Request for Variance from Street Light Spacing Requirements of the Community Facilities Agreement Policy for Phase One of Walsh Ranch and Approve as Built Street Light Spacing for Phase 1B (COUNCIL DISTRICT 3) |
RECOMMENDATION: |
It is recommended that the City Council deny developer request for variance of street light spacing requirement and authorize a variance to Section VIII(II)(A)(1)(d) of the Community Facilities Agreement Policy to allow post top street light spacing at 300 feet, with 200 foot spacing along City parks, in Walsh Ranch Phase 1B. |
DISCUSSION: |
On August 4, 2017, Quail Valley Devco I, LLC, the Developer of Walsh Ranch, requested a variance to the Section VIII(II)(A)(1)(d) of the Community Facility Agreement Policy for Phase 1 of Walsh Ranch. Phase 1 consists of approximately 1,622 acres of land. Section VIII(II)(A)(1)(d) of the Policy authorizes post top street lighting, provided that a complete neighborhood is installed in the same manner, the number of lights are increased to compensate for the lower light levels, and mid-block lights are placed approximately 150 feet apart. The Developer is requesting a variance to the Policy to allow post top street light spacing at 300 feet, with 200 foot spacing along City parks. On August 29, 2017, Council was updated during City Council Work Session on the request for a variance. The Developer is seeking a variance to the City's street light spacing standard for post top lighting on residential streets to create a "dark sky" and a "minimal light pollution" environment. The variance is being sought by the Developer for Phase 1B as well as future phases, including but not limited to phases 1C and 2C. For Phase 1B, the Developer executed a separate CFA for street lighting and sidewalks that included design plans for street lights that were spaced at the current City street light spacing (150 feet) for post top lighting. In constructing Phase 1B, the developer installed street lights with 300 foot spacing. Phase 1B was accepted by the City in error with the incorrect lighting spacing of approximately 300 feet. Staff recommends that a variance be granted for Phase 1B to authorize street light spacing at 300 feet with 200 foot spacing along City parks and that a variance for street light spacing for all other requested portions of Phase I of the Walsh Ranch development be denied. This project is located in COUNCIL DISTRICT 3. This M&C does not request approval of a contract with a business entity. |
