On April 25, 2000, Mayor and Council Communication (M&C G-12897) the City Council approved the Policy Statement on the creation of Local Neighborhood Empowerment Zone (NEZ) and amended it on December 7, 2010 (M&C G-17133) and May 16, 2017 (M&C G-19010), in accordance with Chapter 378 of the Texas Local Government Code. The City Council also authorized the City Manager to develop administrative procedures for the NEZ Program. The NEZ Administrative Procedures were adopted by the City Council on October 3, 2000 (M&C G-13030) and amended on May 15, 2007, December 7, 2010 and May 16, 2017 to initiate improved program requirements. The procedures included a process for NEZ boundary changes or termination: A NEZ area will be terminated when the value of the property inside the NEZ area is 100% or greater of the value of the property located inside loop 820 and outside the NEZ area. The boundary of a NEZ area will be evaluated and possibly adjusted if the NEZ property values are 50% or greater than the value of the properties located inside loop 820 and outside the NEZ area. Any area added to a NEZ must meet the creation guidelines. Property values in each NEZ area will be reviewed every five years.
In accordance with the administrative procedures, the Berry/University, Magnolia Village and Trinity Park NEZ areas meet the criteria for termination. Staff recommends termination of the Berry/University, Magnolia Village and Trinity Park NEZ areas as NEZ designation is not required to promote further development of these areas. A public hearing notice regarding the termination of the NEZ areas was published in the Fort Worth Star-Telegram on August 5, 2017, September 13, 2017 and October 7, 2017. The Berry/University, Magnolia Village and Trinity Park NEZ areas are located in COUNCIL DISTRICTS 3, 8 and 9. This M&C does not request approval of a contract with a business entity.
