SUBJECT:   Authorize Application for and Acceptance of, if Awarded, a Defense Economic Adjustment Assistance Grant from the Governor's Texas Military Preparedness Commission in an Amount Up to $5,000,000.00 for the Purchase of Restrictive Use Easements and Fee Simple Property, Authorize the Use of the City's Restrictive Easements as In-Kind Match, and Authorize Execution of Related Grant Agreement  (COUNCIL DISTRICTS 3 AND 7)

RECOMMENDATION:

It is recommended that the City Council:

1.  Authorize the application for and authorize acceptance of, if awarded, a grant from the Texas Military Preparedness Commission in an amount up to $5,000,000.00 for the purchase of restrictive use easements and fee simple property;

2.  Authorize use of the City's restrictive easement as in-kind match;  

3.  Authorize the execution of the related grant agreement with the State of Texas Governor's office; and

4.  Adopt the attached appropriation ordinance in an amount up to $5,000,000.00, subject to receipt of funds.

 
DISCUSSION:

Defense Economic Adjustment Assistance Grant (DEAAG) is designed to assist defense communities that: 1) are  responding to or recovering from a reduction or termination of defense contracts, 2) have been positively affected with new or expanded military missions, or 3) are encouraging qualified job retention. DEAAG funding is available to municipalities, counties, defense base development authorities, junior college districts and Texas State Technical College campuses, and region planning commissions representing these communities. Funding can be used for positively and negatively affected communities or for proactive projects that will increase the military value of the installation. Projects can include the purchase of property and new construction or rehabilitation of facilities in support of job creation. Grants awarded may range from $50,000 to $5 million per project.

As a defense community, the City of Fort Worth is eligible to apply for a grant from DEAAG. Staff has identified properties within the Accident Potential Zones I at the north and south ends of the base runway, which are areas of high probability of impact in the case of a flight malfunction. Staff proposes to apply for $5 million in DEAAG funds to purchase properties in fee simple and to purchase restrictive use easements from willing property owners. The potential purchase areas are in Council Districts 3 and 7 and depicted on the attached maps. These purchases help to implement the Joint Land Use Study by ensuring uses and population densities are compatible with base operations.

In 2012, the City purchased a restrictive easement for $613,000.00 on a nine-acre tract located at NW Loop 820 and Cahoba Drive (authorized by City Council in M&C L-15466 on November 12, 2012). The value of this easement qualifies as the local funding for this project.

Staff will determine the priorities for properties and/or easements to be purchased with these funds in cooperation with NAS FW JRB staff. All acquisitions will be voluntary and will involve individual appraisals of each property. Staff also intends to work with NAS FW JRB to prepare an application for U.S. Department of Defense Readiness and Environmental Protection Integration (REPI) funds next year for further property acquisition to ensure compatible uses. These DEAAG funds, if awarded, can be used to leverage the REPI funding.

The DEAAG application will be submitted by Monday, October 16, 2017.

This contract will be with a governmental entity, state agency or public institution of higher education:  (Office of the Texas Governor).

This M&C does not request approval of a contract with a business entity.



 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that upon approval of the above recommendations, receipt of the grant, and adoption of the appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Operating Federal Fund.  This is a reimbursement grant..
