RECOMMENDATION:

It is recommended that the City Council authorize the execution of a contract with Botanical Research Institute of Texas in an amount up to $192,000.00, to manage and coordinate the education and volunteer programs for the Fort Worth Botanic Garden.

 
DISCUSSION:

The purpose of this Mayor and Council Communication (M&C) is to authorize the execution of a cooperative Agreement with BRIT, a non-profit organization, for management services for education and volunteer programs, for the Fort Worth Botanic Garden (Agreement).

It is the intent of this collaboration to fulfill the public purpose of increasing community awareness of the Botanic Garden and BRIT and providing visitors at both locations with access to the rich botanical resources consisting of the living collection and the scientific collection that will provide unique learning experiences.  There will also be a coordination of volunteer opportunities to support education and the campus needs of the Botanic Garden and BRIT.

Program implementation will begin after a strategic planning process has been completed, which is anticipated to be completed by spring of 2018.  The term of the agreement shall be for 20 years with no options to renew.  However, the City of Fort Worth may terminate at any time due to failure of the City Council to allocate funding during the annual budget process or with six-months' notice due to failure to achieve jointly agreed goals.  All other major terms and conditions in the Agreement are standard Agreement terms including liability, indemnification and insurance.  Sufficient controls are in place to carry out the public purpose stated above.

The City Manager's Proposed Fiscal Year 2018 budget recommends allocating $192,000.00 through an Agreement with BRIT to ensure the continuation and expansion of the education and volunteer programs currently offered by the City of Fort Worth at the Botanic Garden.

Fort Worth Botanic Garden and BRIT serves ALL COUNCIL DISTRICTS.

 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies upon approval of the Fiscal Year 2018 budget, funds will be available in the Botanic Garden Special Revenue Fund.  Prior to an expenditure being made, the participating department has the responsibility to validate the availability of funds.
