Conduct Public Hearing and Authorize Use of Approximately 0.336 Acres of Handley Park for an Oncor Electrical Easement and Dedication of Street Rights-of-Way for the Handley Meadowbrook Community Center (COUNCIL DISTRICT 5)


RECOMMENDATION:

It is recommended that the City Council:

1.  Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and Recreational Lands;
  
2.  Find that no feasible or prudent alternative exists to the use of Handley Park for the purpose of an Oncor electrical easement and dedication of road rights-of-way;
  
3.  Find that the proposed electrical easement and dedication of road rights-of-way include all reasonable planning to minimize harm to the parkland, as specified on the attached exhibits and as noted in the discussion below;
  
4.  Close the public hearing and authorize the use of approximately 0.336 acres of Handley Park for the Oncor electrical easement and dedication of road rights-of-way; and

5.  Authorize an easement to Oncor Electric Delivery Company, LLC, for an electrical service line for a total of 0.159 acres at Handley Park; and

6.  Authorize the execution and recording of all necessary documents to complete the conveyance.

  • Handley Park - located at 6201 Beaty Street, Mapsco 79H and 80E, south of Greenlee Street, west of Haynie Street, north of Beaty Street and east of East Loop 820, in Council District 5.
 
DISCUSSION:

The purpose of this Mayor and Council Communication (M&C) is to authorize the granting of an electric easement to Oncor Electric Delivery Company, LLC (OED), and dedication of road rights-of-way at Handley Park for the purpose of construction improvements at Handley Meadowbrook Community Center.

The City of Fort Worth requires the platting of Handley Park as part of the Handley Meadowbrook Community Center project. Platting requires that dedicated rights-of-way are provided for the existing Haynie Street located on the eastern boundary of the park. The Transportation Public Works Department is requesting the dedication of a 29.10 foot wide right-of-way along Haynie Street within the park boundary which extends to approximately the centerline of the street.  This equates to a 7,711.50 square foot right of way dedication.



The Oncor Electrical easement is required for the new transformer that will service the Community Center.  The proposed easement will result in approximately 6,920.00 square feet of parkland area being granted.

On May 24, 2017, the Park and Recreation Advisory Board endorsed staff's recommendation to the City Council to authorize the use of the Park for the purpose of an electrical easement and dedication of road rights-of-way in Handley Park.

In accordance with State law, public notice was advertised in the Fort Worth Star-Telegram on May 24, 2017, May 31, 2017 and June 7, 2017.  An exhibit map was available for public review for 30 days at the Park and Recreation Department's administrative offices located at 4200 South Freeway, Suite 2200, Fort Worth, Texas 76115.

Signage was posted at the site on May 24, 2017, announcing the proposed use and providing instructions for directing comments to the PARD.  A letter announcing the proposed use was sent to the president of the Handley Neighborhood Association.  During the report of Staff, Staff will note any public comment that has been received.

Handley Park is located in COUNCIL DISTRICT 5.

This M&C does not request approval of a contract with a business entity.
