The Texas Local Government Code Chapter 43, Sections 43.023, 43.142 and 43.031, authorizes adjacent municipalities to make mutually agreeable changes in their boundaries, and release extraterritorial jurisdiction by ordinance. The City of Fort Worth and the City of Saginaw wish to make changes to the boundaries of each City which will promote orderly development, public safety, and effective delivery of municipal services. The joint ordinance also addresses signal light maintenance, which Saginaw currently provides. Since October 2016, the two cities have been working toward mutual understanding on a jurisdictional boundary agreement. The agreement stipulates that Saginaw will continue to maintain the traffic signal installed by the City of Fort Worth at the intersection of Old Decatur and WJ Boaz. As a result of these discussions, the joint ordinance will enforce the 1985 Intercity Agreement between Fort Worth and Saginaw whereby once the construction of Old Decatur Road has been completed by the City of Fort Worth, then Saginaw will annex the entire right-of-way. As such, the joint ordinance identifies the entire width of the Old Decatur Road right-of-way from the Bailey Boswell Road intersection south to Marine Creek Road to be incorporated into Saginaw's jurisdiction. The boundary adjustment will transfer approximately 6.4 acres of Fort Worth city limits and 1.7 acres from Fort Worth's extraterritorial jurisdiction to Saginaw's jurisdiction. This boundary agreement results in the jurisdictional boundaries as shown on the attached exhibit. The boundary adjustment area is located in COUNCIL DISTRICTS 2, 7 and the adjacent extraterritorial jurisdiction of Tarrant County. This contract will be with a governmental entity, state agency or public institution of higher education: (City of Saginaw). |
