Consider Institution and Adoption of an Ordinance for Proposed Owner-Initiated Annexation of Approximately 841.8 Acres of Land in Tarrant County, Located West of Business 287, North Along Boat Club Road and Park Drive, in the Far Northwest Planning Sector (FUTURE COUNCIL DISTRICT 7)


RECOMMENDATION:

It is recommended that the City Council institute and adopt the attached ordinance annexing approximately 841.8 acres of land in Tarrant County, west of Business 287, north along Boat Club Road and Park Drive, for full purposes as shown on Exhibit A.

 
DISCUSSION:

On October 10, 2016, representatives for the property owners, BOA Sorte Limited Partnership, submitted an application for full-purpose annexation of the above referenced property into the City of Fort Worth. Included in this proposed annexation is property owned by Oncor Electric Delivery CO., LLC, which has joined the annexation request.  The proposed annexation areas are comprised of agricultural uses and vacant land.  The majority of the property is already annexed for limited purposes and is subject to zoning, as part of the larger Eagle Mountain 8W and 10 (AX-02-0008) annexation.

The area that is currently in the limited-purpose annexation is zoned Agricultural "AG" and Industrial "I".  About 16.2 acres out of the approximately 841.8 acres is in the City's extraterritorial jurisdiction and is not zoned.  In accordance with Section 4.102D of the City's Zoning Ordinance, this area automatically defaults to Agricultural (AG) zoning upon annexation.  The applicant submitted a zoning application requesting "A-7.5" One-Family, "A-5" One-Family, and "E" Neighborhood Commercial zoning for a master planned community, containing approximately 2,500 homes.  The City Council denied this zoning case on April 4, 2017 (ZC-16-204) so that the applicant can revise the residential lot sizes and zoning districts proposed.

The proposed uses were considered while assessing the financial impact to the General Fund. This property currently produces tax revenue of approximately $38,410.00 annually.  Based on the operating costs projected from the Police, Code Compliance, and Transportation and Public Works Departments, the fiscal impact shows a slightly negative annual effect to the General Fund for the first year, but will have a positive impact thereafter.  The fiscal impact analysis shows that the property will have a long-term positive impact to the General Fund, based on the proposed development.  Therefore, due to the ability of the area to meet the City's criteria for full-purpose annexation, staff recommends approval of the requested owner-initiated annexation, AX-16-009.

The City is able to provide municipal services upon annexation in accordance with state law without negatively impacting service provision within the City.  Annexation of this site is consistent with the City's 2017 Comprehensive Plan.

If annexed for full purposes, this property will remain part of COUNCIL DISTRICT 7.

This M&C does not request approval of a contract with a business entity.
 
FISCAL INFORMATION/CERTIFICATION:

The Director of Finance certifies that the long-term fiscal impact of the annexation will be incorporated into the City's five-year projections.
