Adopt Ordinance Vacating a Portion of Lake Country Drive to be Replatted with the Existing Entry Feature and Fountain for the Lake Country Estates Home Owners Association (COUNCIL DISTRICT 7)

It is recommended by the City Plan Commission that the City Council:

1.  Adopt the attached ordinance vacating a portion of Lake Country Drive to be replatted with the existing entry feature and fountain owned by the Lake Country Estates Home Owners Association; and

2.  Waive any and all purchase fee value of the vacated land in accordance with City policy.

Prospect Surveying, on behalf of the Lake Country Estates Home Owners Association, has requested the vacation of this right-of-way to be replatted for the existing entry feature and fountain for the Home Owners Association (HOA). The City Plan Commission recommended approval of this request at its meeting on January 27, 2016. An acceptable final plat (FS-16-055) has been received in accordance with the Subdivision Ordinance.    

The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process.  The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements.  In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easement for the street and alley.
