Adopt Ordinance Vacating Portions of N.W. 7th Street, N.W. 8th Street, North Throckmorton Street, North Houston Street, All of Refinery Street and Two Alleys in North Fort Worth Addition for the Trinity River Vision Master Plan (COUNCIL DISTRICT 2)

It is recommended by the City Plan Commission that the City Council:

1.  Adopt the attached ordinance vacating portions of NW 7th Street, NW 8th Street, North Throckmorton Street, North Houston Street, all of Refinery Street and two alleys in North Fort Worth Addition for the Trinity River Vision Master Plan; and

2.  Waive any and all purchase fee value of the vacated land in accordance with City policy.

The Tarrant Regional Water District has requested the vacation of these rights-of-way to be included within the Federal Floodway Project for the bypass channel as a part of the Trinity River Vision Master Plan. The City Plan Commission recommended approval of this request at its meeting on November 18, 2016 and a waiver to the requirement to include the vacated rights-of-way in a final plat. Tarrant Regional Water District  has stated that the areas outside of the Federal Floodway area will be final platted before any development may occur, and has provided a timeline for platting prior to construction.    

The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process.  The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easements.  In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easement for the street and alley.
