Repeal Resolution No. 4624-05-2016 and Adopt Ordinance Vacating a Portion of Southgate Drive to be Replatted with the Adjoining Property by QuickTrip to Realign the Commercial Driveway Entrance into the QuikTrip near the Intersection of McCart Avenue and IH-20 (COUNCIL DISTRICT 6)


RECOMMENDATION:

It is recommended by the City Plan Commission that the City Council:

1.  Repeal Resolution No. 4624-05-2016 and adopt the attached ordinance vacating a portion of Southgate Drive to be replatted with the adjoining property by QuikTrip to realign the commercial driveway entrance into the QuikTrip near the intersection of McCart Avenue and IH-20; and

2.  Waive any and all purchase fee value of the vacated land in accordance with City policy.

 
DISCUSSION:

On May 3, 2015, the City Council adopted Resolution No. 4624-05-2016 closing a portion of Southgate Drive to alleviate traffic in the surrounding neighborhood.  Over the summer the Texas Department of Transportation in discussion with QuikTrip requested as part of construction a deceleration lane along IH-20 that QuikTrip work with the City to realign Southgate or their entrance to their gas station to provide a safer condition.

Survey Consultants Inc., on behalf of QuikTrip, has requested the vacation of this right-of-way to be replatted with the adjoining property to realign the commercial driveway entrance into the QuikTrip located near the intersection of McCart Avenue and IH-20.  The City Plan Commission recommended approval of this request at its meeting on August 24, 2016.  An acceptable final plat (FS-15-263) has been received in accordance with the Subdivision Ordinance.  

The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process.  The City does not own any fee interest in the right-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the right-of-way easement.  In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), Staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easement for the street and alley and repealing Resolution No. 4624-05-2016.

This project is located in COUNCIL DISTRICT 6, Mapsco 90T.

This M&C does not request approval of a contract with a business entity.

The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
