RECOMMENDATION: |
It is recommended that the City Council authorize the execution of a Credit Sales Agreement with Rockin' K on Chambers Creek, LLC, a Mitigation Bank, and the City of Fort Worth in the amount of $385,482.00 for wetland mitigation in the Greenfield Acres Drainage Improvements Project. |

DISCUSSION: |
This Agreement is for the purchase of wetland mitigation bank credits required in the Greenfield Acres Drainage Improvements Project to comply with the Clean Water Act, administered by the US Army Corps of Engineers (USACE). The drainage improvements, which require two large detention ponds, are needed to protect homes in the Greenfield Acres and Marine Creek Meadows neighborhoods from flooding. A natural stream traverses the location of the two ponds, and the USACE has determined that there are impacts to the stream which must be mitigated.
The Rockin' K on Chambers Creek Mitigation Bank (RKCCMB) administers off-site wetland mitigation for the USACE. The Greenfield Acres Project requires the purchase of 441.21 wetland mitigation credits from the RKCCMB at a cost of $385,482.00.
On September 27, 2011, (M&C C-25189) the City Council authorized the design of Greenfield Acres Storm Drain Improvements. Construction is expected to commence in Spring 2017.
Funds for the purchase of the mitigation credits are available in the project budget. Funding for the project is being provided from the Stormwater Capital Projects Funds.
This project is located in COUNCIL DISTRICT 2, Mapsco 46L and 46M.

The Director of Finance certifies that upon approval of the above recommendation, funds are available in the current capital budget, as appropriated of the Stormwater Capital Projects Fund (52002), Stormwater Capital Projects Bonds Fund (59651), Stormwater Capital Projects Legacy Fund (59652) and Stormwater Capital Projects 2007 Fund (59653). Funding for the project is shown below:
